INK-AI declaration
Licence on publication
By publishing Material in a feature covered by INK-AI, the User grants YOUPROMO a non-exclusive licence to that specific Material. The licence arises at the moment the Material is published. No checkbox needs to be ticked again for each publication.
Condition for using the features
Granting the licence is a condition for using the features of adding free designs, last-minute booking and matching clients with artists. Without the licence these features are not available. An Account may add a new free design only if all of its free designs that it can cover by the licence are covered by it, including designs left out at acceptance, withdrawn or covered by a notice of termination.
Scope of the licence
The licence covers recording and reproducing the Material by digital means, storing it on servers, in the cloud and in datasets, making technical changes, annotation, text and data mining, training, testing and evaluating AI models, and using the results in search, recommendations, booking and matching clients with artists.
YOUPROMO may crop, scale, mask, remove the background and metadata and make other technical changes needed to carry out the project.
The licence is non-exclusive, worldwide and granted for an indefinite period, with the right of termination in accordance with Article 68(1) of the Polish Act on Copyright and Related Rights. The licence is granted without separate monetary remuneration. The User's benefit is access to the INK-AI features.
The licence also covers storing Materials, datasets, tags and vector representations after the end of research and development work, to the extent and for the period necessary to ensure the reproducibility of results and to meet the project's documentation obligations.
Declaration of rights
The User declares that they are the author of the Material or hold the rights allowing them to publish it and grant the licence. The declaration covers the rights to the photograph and to the tattoo design shown.
Free designs
By publishing a free design, the User declares that they are its author or hold the rights allowing them to grant the licence to YOUPROMO. The User may not publish as free designs materials to which they do not hold the required rights.
Studio account
The studio indicates the author of the design and declares that it holds the rights, a licence allowing a sub-licence to be granted, or the author's appropriate authorisation. At YOUPROMO's request, the studio provides confirmation of this basis.
Materials already published
The licence to previously published Materials covers only the items shown to the User before acceptance. The User may review the list and remove chosen Materials from it. Materials removed from the list remain in the Service; until they are covered by the licence or deleted, the Account cannot add new free designs.
Withdrawing material
The User may withdraw Material from future use in INK-AI. YOUPROMO blocks it from being added to new datasets and removes it from active datasets without undue delay. Withdrawal does not affect lawful use made earlier. Material is withdrawn and restored in "My designs". Until a withdrawn free design is restored or deleted, the Account cannot add new free designs.
Infringement of rights
YOUPROMO may block or remove Material in the event of justified doubts concerning copyright, image rights or privacy. The author, the person shown in the photo or another rightholder may report an infringement via the contact form at https://hapink.com/contact.
